1. Your UniPAY Account
1.1 Your UniPAY account is an electronic money account which enables you to send and receive money electronically.
1.2 Your electronic money account does not expire and does not earn any interest.
1.3. You are eligible to withdraw sums from UniPAY account, though it is necessary preliminarily to confirm personal data. According to the actual situation you might be required to submit additional documentation.
1.4 You have the right to withdraw the money from your UniPAY account at any time, however you might be asked to confirm your personally identifiable information.
1.5 Minimal amount of withdrawn sum of money is determined in 1 unit of currency; however the money on your account should be sufficient to cover applicable withdrawal fee.
1.6 While submitting the withdrawal of funds you are able to choose the withdrawal procedure which is convenient for you from UniPAY web-site, you are as well able to withdraw money from UniPAY service centers against ID card or passport.
1.7 Remember: electronic money accounts are not bank accounts.
1.8 Electronic funds on UniPAY account belong to that individual or legal entity that is registered as account holder.
1.9 The funds on the UniPAY account can be used only by the account holder; no other person has the right to use the account, except in cases of succession.
1.10 You have no right to assign or transfer your UniPAY account or legal interest on it to a third party.
1.11 Your UniPAY account may be subject to upload, payment and withdrawal limits depending on your verification status.
2. Opening Accounts
During registration it is necessary to define what kind of account you are going to open in UniPAY system, the one for individual or for legal entity.
The registration of legal entities is regulated by agreement for legal entities.
Accounts for Individuals
2.2 While using additional services you might need to accept/agree with additional terms and conditions.
2.4 In order to use UniPAY services you have to be of the full legal age, which you automatically declare during registration.
2.5 This does not apply to those services on which we set different age limits.
2.6 We might request your age identification card at any time.
2.7 You have the right to open only one UniPAY account.
2.8 The information you provide while registration or any other time should be correct, accurate and active.
2.9 You can only add payment instruments to UniPAY account (bank accounts, credit cards, debit cards, etc) if you are the named holder of these instruments.
2.10 An attempt to add the payment instrument of which you are not the named holder will be treated as fraudulent activity.
2.11 You have the right to close your UniPAY account within 30 days after opening by notifying UniPAY administration. Uploaded funds your account can be withdrawn after confirming your identity.
2.12 Transactions and fees for transactions undertaken before the closure of your account, including those transactions that irrevocable and have been initiated but not completed before account closure, will not be refunded.
2.13 By accepting these Terms and Conditions you agree to the transfer of your personal data or requesting /receiving your personal data from the person/entity with whom the exchange of the above-mentioned information is permitted by Georgian legislation.
3. Maintaining Accounts
3.1 You must ensure that the information recorded on your UniPAY Account is always accurate and up to date. We shall not be liable for any loss arising out of your failure to do so.
3.2 We may ask you at any time to confirm the accuracy of your information or to provide documents or other evidence.
3.3 We may contact you by e-mail or in various other ways and provide you with information or notices regarding your UniPAY account.
3.4 It is your responsibility to regularly check the proper functioning of your e-mail account or other methods of communication (see article 16.Communication) which you have registered with your UniPAY account. You are also responsible to retrieve and read all the messages related to your UniPAY account.
3.5 We shall not be liable for any loss arising out of your failure to do so.
3.6 Your UniPAY fund uploads, payments received, payments sent, exchange and fund withdrawals are displayed in your online transactions history.
3.7 Each transaction is given a unique transaction ID and shown in the transaction history.
3.8 You should quote this transaction ID when communicating with us about a particular transaction.
3.9 You should check your account balance and transaction history regularly. You should report any irregularities or clarify any questions you have as soon as possible by contacting UniPAY administration.
4. Keeping UniPAY Account Safe
4.1 You must keep your account password safe at all times and never disclose it to anyone
4.2 UniPAY will never ask you to provide your password to us or to a third party. We will never ask you to make a transaction on UniPAY or other payment instruments accounts, we will not ask you to pay any fees which are not described and regulated by these terms and conditions.
4.3 If you have any doubts about a message you receive or a website you visit should be reported to UniPAY administration. Avoid using strange websites and responding to doubtful messages. We shall not be liable for any loss arising out of your failure to do so.
4.4 We recommend you to change the password once in three months and never write it down or store it anywhere that is easy to find.
4.5 You should never allow anyone to access your account or watch you accessing your account. You should not choose a password that is easily guessed from information someone might know or gather about you or choose a password that has a specific meaning.
4.6 If you have any indication or suspicion of your login details, password or other security feature being lost, stolen, misappropriated, used without authorization or otherwise compromised, you should change your password and you must contact UniPAY Administration.
4.7 Any undue delay in notifying us may negatively affect on the security of your UniPAY account.
4.8 You can at any time suspend or otherwise restrict the functionality of your UniPAY account if you suspect that it has been accessed by another person without your authorization or suspect that it has been otherwise compromised.
4.9 You must also take all reasonable care to ensure that your e-mail accounts are secure and only accessed by you, as your e-mail address may be used to reset passwords or to communicate with you about the security of your account.
4.10 In case any of the e-mail addresses registered with your UniPAY accounts are compromised, you should immediately contact UniPAY Administration and also contact your e-mail service provider.
4.11 If you are using a public or shared computer to access your UniPAY account, you must ensure that your login details are not stored by the browser or cached or otherwise recorded.
4.12 If you are using your own computer, you must ensure that only you have access to it.
5. Security key
5.1. This is the additional security mechanism with the help of which you are sent a message to your phone number verified on your account, stipulating the code of operations of such type, as logging in and providing payments.
5.2. Security code is activated to the phone number verified in your electronic wallet. You are able to switch on/off additional security mechanism from your UniPAY account parameters. For clarifying details regarding the existed problem on the usage of additional security codes, please, contact Security Administration.
Account telephone code is generated in the system when entering your electronic wallet by you; it is necessary for obtaining financial information. For receiving your answer, you shall dictate the operator the telephone code.
When the system operator is contacted not by UniPAY user but his/her representative, the Operator shall request the consent of the real owner of the account for the issuance of information or conversation with the Owner.
6. Closing Account
6.1 You have the right to close UniPAY account at any time by notifying UniPAY administration.
6.2 If your account holds a balance by the time of the account closure, you must withdraw it within 15 working days during which your account will be accessible only for the purpose withdrawal the remaining balance only. In this case, your obligations regarding the safety of your account will continue to apply.
6.3 If you do not withdraw funds within the period defined in 5.2 we might (but will not be obliged to) send you the amount from your UniPAY account to any other verified bank account if any exists, and charge you a withdrawal fee including applicable foreign exchange fees.
6.5 Closing your account does not extinguish the personal data we hold on you and we will continue to store such data, including transaction history.
6.5. After opening UniPAY account, you are eligible to close the account by contacting UniPAY administration. In case if you have a sum of money at your UniPAY account, before the withdrawal of the money you will be required to submit identification document.
Transactions provided before closing the account and costs paid for the transactions (including such transactions, which are not subject to cancellation and are started, but not completed before closing of the account), are not subject to reimbursement.
7. Reopening of account
In case of closing the account of the system user, reopening of the account shall take place through filing an application. UniPAY Administration will consider the Application and make a decision about opening/not opening of the account.
8. Wallet verification and its statuses
Status of electronic wallet in UniPAY system shall be determined as unverified and verified.
Account status is verified if it undergoes all required verification requirements, in case of failure of verification – the status is uncertified.
Notwithstanding his/her status, the consumer ordinarily provides using of electronic wallet, except the functional requiring verified status.
Requirements for the verified status are:
-verifying bank card;
-verifying mobile number;
-verifying identity document or passport;
-Transferring sum to the personal bank account or entering money from the account.
In case of providing incorrect information during verification, the user is automatically banned.
9. Operation of filling your UniPAY balance
9.1. You can fill your UniPAY balance through UniPAY branches and the filling methods provided on UniPAY website.
9.2 For uploading funds you should log into your UniPAY account and follow the relevant upload instructions.
You may be presented with a number of different upload methods, depending on which payment instruments you have added to your UniPAY account and which payment methods are available for you.
9.3 Upload methods are payment services provided by third-party financial institutions and are not part of the UniPAY service.
9.4 UniPAY does not guarantee the use of any particular upload method and may make available, make changes to or discontinue the acceptance of any particular upload method at any time without following the procedure.
9.5 UniPAY shall not be responsible for the upload payment until the uploaded funds are received on its account.
9.6 You may be asked to answer security questions or to complete other activities that we may reasonably require to ensure proper authorization of an upload transaction
9.7 Uploads may be subject to upload limits due to security and legal requirements.
9.8In case if entering money against UniPAY account was provided through such method of payment, which allows chargeback of the sum, such as (without limitation) credit and debit cards and Direct Debit, you give your consent for using chargeback right, except cases, when payment instrument was used by unauthorized person or if UniPAY breached present Terms and Conditions, allowing you to request reimbursement of the entered sum. You are illegible to return the sum transferred through transaction of filling the account or request chargeback on the transaction of filling the account, for the reasons, UniPAY is not responsible for, which without limitation includes the claims with the merchant regarding failure to deliver goods or services, as well as instrument of payment related with the existence of the respective balance of the sum on the account. We reserve the right to charge you with all kinds of commission fees and taxes, which we are charged with in connection with the chargeback, or any action taken for the same reason. We are also eligible to charge you with chargeback commission fee in the amount of GEL 60.
9.9You are eligible to notify the merchant your desires regarding regular use of UniPAY account and allow him to provide automated deduction (payment) of the sum from your UniPAY account in case of each repeated payment. In such case, you allow UniPAY in case of each following payment to deduct the sum from particular payment instrument (credit or bank card), from which you provided principal payment (filling the account) for the purpose of implementation of the following payments.
You give your consent for not to cancel or otherwise provide cancellation of the above further payments or terminate payments through contacting with the issuer company (bank provider) of the payment instrument.
In order to cancel further payments in the future, you are liable to notify about it:
b)A respective merchant from which you have purchased the good or service and which you want to cancel further payments with.
Based on the content of the provisions stipulated in the Articles 9.8 and 9.7 herein, if using the right of requesting a chargeback or accrued sum back gives rise to showing negative balance at your UniPAY account, you are liable to cover the said negative balance through entering the respective sum of money against your UniPAY account. Breaching of the said condition shall be deemed to be breaching of present Service Terms and Conditions. Liability for covering negative balance is activated immediately, without notification, provided that we reserve the right to send you respective notice or take other actions for repayment of your debt any time, which considers (without limitation) transferring the issue to the institution or a company authorized for the clearance, or referring to the court. We also reserve the right to charge you with all the expenses incurred by us in connection with the repayment of the debt or enforcement activities.
9.10Subject to the transaction purposes of filling the account realized from the payment instruments, UniPAY is the recipient of the payment and not the provider of payment service.
9.11You are illegible to realize transaction by using the instrument of payment, which is not issued to you. We treat breaching of the said liability complete seriously and respectively, every attempt to provide transaction from the payment instrument issued to another person will be considered by us to be a fraud. Together with requesting additional means of loss reimbursement, we are eligible to charge you with administrative payment in the amount of GEL 60, in case if we are requested to refund the sum, transaction of which was provided by using payment instrument issued to another person.
9.12Realizing transaction of filling the account, according to the Article 15 herein, is subject of charging with commission fees and currency conversion, amount of which depends on the method of realizing the operation of filling the account and payment instruments.
10. Sending Payments
10.1 To send a payment you should log into your UniPAY account and make a payment.
10.2. In order to send the sum to the desired recipient inside UniPAY System, he/she shall be registered in UniPAY System with active email. Notwithstanding this, you can send the sum to unregistered users, who will receive the notice about receiving of the sum to the email sent by you. You can cancel the transaction of the unregistered user if it is not completed. Cancellation may be provided through transaction panel, if the transaction is not activated in the recipient’s email, it will be canceled automatically in 48 hours and returned to the due balance.
You shall type the address you want to send the money carefully and accurately. UniPAY uses email for the unique identifier, in order to determine the desired recipient of the sum you asked to process.
10.3 You will not be able to cancel transactions that have already been credited to the recipient.
10.4 Sending payments in the system is not charged by any fees.
11. Receiving Funds
11.1 If you receive funds into your UniPAY account, we will send you a notification e-mail and display the payment as a Receive Money Transaction in your transactions history.
11.2 You should regularly reconcile incoming payments with your own records.
11.3 Receipt of payments to your account does not necessarily mean that these transactions cannot be reversed. UniPAY reserves the right to reverse a payment in case the payer or the payer’s bank or payment service provider has charged back or otherwise reversed an upload or other payment.
12. Paying for Services/Products
12.1 When you are purchasing services or products via UnipPay account you are requested to learn the terms and conditions of the offered services/products on the service provider’s website. With the help of UniPAY you make a payment only, accordingly UniPAY’s obligation is restricted only by making a transaction. UniPAY does not take any responsibility for the quality of the provided products or services.
12.2 Any payment you make via UniPAY account automatically means that you are aware of what service or product you pay for and will not have any complaints regarding this issue.
12.3 It is your responsibility to provide correct information necessary for making a payment. UniPAY shall not be liable for the incorrect transaction made by you while purchasing services/products included in the UniPAY system. In this case UniPAY is not obliged to suspend a transaction or refund payment, however, we will reserve the right to show goodwill and assist you in regard to this issue within our capacity.
13 . Prohibited Transactions
13.1 It is strictly forbidden to send or receive payments as consideration for the sale or supply of:
Drugs and drug paraphernalia
Firearms or ammunition
Weapons and knives
Satellite and cable TV descramblers
Government IDs and licenses including replicas and novelty items
Unlicensed lotteries or gambling services
Prepaid debit cards or other stored value cards that are not associated with a particular merchant and are not limited to purchases of particular products or services
Multi-level marketing, pyramid selling or ponzi schemes, matrix programs or other “get rich quick” schemes or high yield investment programs
Goods or services that infringe the intellectual property rights of a third party
13.3 It is strictly forbidden to make payments to or to receive payments from persons or entities offering illegal gambling services, including (but not limited to) illegal sports betting, casino games and poker games.
13.4 We may suspend or terminate your UniPAY Account at any time or refuse to execute or reverse a transaction if we believe that you directly or indirectly violate the rules described in article 9.
13.5 You may not use UniPAY’s services if you live in any of the following countries:
Korea( people republic )
Antigua - Barbuda
Trinidad and Tabaco
This list is not exhaustive and we may in our sole discretion decide to discontinue or restrict our services in other countries at any time and without prior notice.
13.6 It is strictly forbidden to use your UniPAY Account for any illegal purposes including but not limited to fraud and money laundering.
13.7 UniPAY will report any suspicious activity to the relevant law enforcement agency.
13.8 You are prohibited from using your UniPAY account in an attempt to abuse, exploit or circumvent the usage restrictions imposed by a merchant on the services it provides.
13.10.In case of taking actions prohibited in this Article, the Company UniPAY reserves the right to deduct or stop the sum existed on your account at immediate basis.
14. Withdrawing Funds
14.1 You can request a withdrawal of all or part of the funds held in your UniPAY account at any time. To do this you must log in to your account and select a withdrawal method and enter the amount to be withdrawn.
14.2 Withdrawal methods are payment services provided, at least in part, by third-party financial institutions (for example, the bank where you hold a bank account).
14.3 UniPAY does not guarantee the availability of any particular withdrawal method and may make available, make changes to or discontinue a particular withdrawal method at any time without following any procedure.
14.4 There is at least one withdrawal method available in the system.
14.5 When the withdrawal payment is received by you through the involvement of a payment service provider (such as the bank where you hold a bank account), UniPAY shall not be responsible for the withdrawal payment once the withdrawn funds are received by your payment service provider.
14.5 Withdrawals are subject to withdrawal fees. The withdrawal fee will be defined against withdrawal request.
14.6 You must not make a withdrawal to a bank account or other payment instrument if you are not the named holder.
14.7 We take any violation of this requirement very seriously and will treat any attempt to use a payment instrument of which you are not the named holder as a fraudulent act.
14.8 You must ensure that the payment details you enter when withdrawing funds are correct and complete.
14.9 UniPAY will not be liable for transaction due to providing incorrect payment details.
14.10 When withdrawing to a bank account, you must ensure that the number of funds, account number, sort code, IBAN format, name and ID code are correct.
15.1 Fees depend on the type of the account you possess in UniPAY system.
15.2 Transaction related fees can be viewed at any time in the Fee Section on our Website.
15.3 Fees are subject to change at any time. The revised information will be available on our website.
15.4 Under certain circumstances we may charge additional fees.
15.5 Your transactions may be subject to currency conversions.
For each currency conversion UniPAY will use active exchange rate of the Bank for the moment of payment. In case of conversion of the sum of money received from other electronic wallet or account, or the sum realized in their direction, currency exchange rate shall be determined by UniPAY. We are eligible to use additionally foreign currency exchange rate in the form of interest, used in addition to the transaction fees.
15.6.The fees due by you will be deducted from your UniPAY account balance. Transaction fees are charged after the completion of the transaction. If your account balance is not enough for covering the fee, we refuse to implement the transaction.
16.1 You should check the transactions history of your account regularly and frequently and contact UniPAY administration in case you have any questions or concerns.
16. 2 Subject to the foregoing, UniPAY shall not be liable for any disruption or impairment of its service or for disruptions or impairments of intermediary services on which UniPAY relies for the performance of its obligations hereunder, provided that such disruption or impairment is due to abnormal and unforeseeable circumstances beyond its reasonable control or the control of the intermediary affected.
16.4 UniPAY shall not be liable for the assessment or payment of any taxes, duties or other charges that arise from the underlying commercial transaction between you and another UniPAY customer.
17. Termination and Suspension
17. 1 You may terminate your account with us at any time by notifying UniPAY administration, by submitting all necessary documentation we will provide the suspension of your UniPAY account.
17.2 Different termination rights may apply under a Legal Agreement if you hold a Legal Entity Account.
17. 3 We can terminate or suspend your UniPAY account at any time without notice in case:
you violate or we have reason to believe that you are in violation of any law or regulation that is applicable to your use of UniPAY services; or f we have reason to believe that you are in any way involved in any fraudulent activity, money laundering, terrorism financing or other criminal activity.
18.2 Any changes applied to these terms and conditions will come into effect immediately.
18.3 UniPAY shall give notice to you of any proposed change by sending an e-mail.
19.1 we usually communicate with you by the e-mail registered with your account.
19.2 You are requested to check our messages regularly and in case of any misunderstandings, you should contact UniPAY administration.
19.3. E-mails may contain links to further communication on our website.
19.4 You are required to keep copies of all communications we send or make available to you.
19.6 We will communicate to you in Georgian and will always accept communications made to us in Georgian.
For non-standard communication, we reserve the right to communicate with you in English. Documents or communications in any other languages are for convenience only and shall not constitute an obligation on us to conduct any further communication in that language.
19.7 Apart from communicating via e-mail, we may contact you via letter or telephone, where appropriate. If you use any mobile services, we may communicate with you via SMS.
You may contact UniPAY administration via e-mail, phone or any other contacts displayed on our website.
20.1 Your UniPAY account is regulated and defined in accordance with Georgian legislation.
